1. Scope

1.1 The following General Terms and Conditions (AGB) are part of the contracts concluded between the customer and flugsimulator.com GmbH, represented by Managing Director Walter Drasl, Gerold-Janssen-Str. 5, 28359 Bremen, hereinafter referred to as flugsimulator.com, regarding participation in a flight simulation.

1.2 flugsimulator.com sells vouchers and simulator flights in its own name and for its own account. flugsimulator.com arranges these simulator flights with verified providers exclusively on the basis of these General Terms and Conditions (hereinafter “AGB”). These AGB govern the legal relationship between flugsimulator.com and you as the purchaser. The respective redeemer or voucher holder is also bound by these AGB.

1.3 Side agreements and other deviations that change the scope of contractual services require our express confirmation.

1.4 Agreements made between the contracting parties in individual cases (including side agreements, supplements, and amendments) take precedence over these AGB in all cases.

1.5 Customers within the meaning of these AGB are both consumers and businesses.

2. Conclusion of contract

2.1 The contract is concluded as follows: The listing of flight simulations on the flugsimulator.com website does not constitute an offer in the legal sense. By making an inquiry, the customer bindingly declares their offer to contract. Input errors can be corrected before submitting the order using the usual keyboard and mouse functions. By clicking “Anfrage senden” you submit a binding offer to conclude a contract. Upon receipt of the customer’s offer by flugsimulator.com, the customer will receive an automatically generated email confirming receipt of the registration and its details. This confirmation does not constitute acceptance of the offer by flugsimulator.com. Acceptance will either be expressly declared or will take place upon invoicing.

2.2 The contract text is stored by flugsimulator.com and sent to the customer together with the applicable AGB by email.

2.3 You can also book your participation in person, by phone, or in writing.

3. Service, dates

3.1 The scope of contractual services is determined solely by the service descriptions on the flugsimulator.com website and the corresponding details in the invoice.

3.2 After receiving the participation confirmation/invoice and payment instructions, the participant contacts flugsimulator.com to arrange their desired date for the simulator flight.

3.3 At certain locations, flights on various simulators are conducted during free periods when the simulators are not required for pilot training. If the desired date is already booked by professional pilots, flugsimulator.com will coordinate an alternative date with the participant.

3.4 On all flugsimulator.com GmbH simulators there is a minimum age of 12 years (or 10 years without motion) when accompanied by an adult, otherwise 16 years. Participation in simulator flights on Lufthansa Full Flight Simulators is only permitted for persons aged 16 and over.

4. Prices, VAT, and payment

4.1 The stated prices are final prices including statutory Mehrwertsteuer.

4.2 Payment methods available: bank transfer, credit card, EC card, PayPal, and cash payment.

4.3 The amount stated on the invoice is due immediately, but no later than two weeks after receipt of the invoice.

4.4 Any issued credit notes will be refunded within 14 days.

5. Non-participation, rebooking, or substitute person

5.1 You can cancel your participation in the simulator flight at any time. Cancellation must be made in text form, stating your booking number.

5.2 If you cancel the contract or do not attend the simulator flight, we may charge reasonable compensation for arrangements made and expenses incurred. When calculating compensation, we will take into account any savings and possible alternative use of the simulator.

5.3 The refund amount is calculated from the fee minus a processing fee, which we must unfortunately charge per registered participant in the event of withdrawal:

• 10% of the fee up to 30 working days before the date

• 30% from 29 to 15 working days before the date

• 50% from 14 to 7 working days before the date

• 100% from 6 working days before the date.

5.4 The amounts are rounded up to the nearest full EUR. Working days are Monday to Friday; Saturdays, Sundays, and public holidays are not considered working days.

5.5 A rebooking of your simulator flight is possible, and we charge EUR 20 per person for administrative costs. Rebookings from 7 working days before the date are treated as a cancellation. We will then attempt to fill the vacant spot with another participant. If successful, only the rebooking fee will apply.

5.6 You may name a substitute participant at any time.

6. Liability

For damages to legal interests other than life, body, or health, liability is excluded unless the damages are due to intentional or grossly negligent conduct by flugsimulator.com, its legal representatives, or vicarious agents, and the conduct does not constitute a breach of essential ancillary obligations of the contract. This exclusion does not apply to claims under the Produkthaftungsgesetz.

7. Right of withdrawal

7.1 You may withdraw from your contractual declaration within 14 days without giving reasons in text form (e.g., letter, email). The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfillment of our information obligations according to Artikel 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB as well as our obligations under § 312e Abs. 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB.

7.2 To meet the withdrawal deadline, it is sufficient to send the withdrawal in time. The withdrawal must be addressed to:

7.3 In the event of a valid withdrawal, the services received by both parties must be returned and any benefits (e.g., interest) surrendered. If you cannot return the received service in whole or in part or can only return it in a deteriorated condition, you may be required to provide compensation for value. This may mean that you must still fulfill your contractual payment obligations for the period up to the withdrawal. Payment refund obligations must be met within 30 days. For you, the period begins with the dispatch of your withdrawal notice, and for us, upon receipt.

7.4 Your right of withdrawal expires prematurely if the contract has been fully performed by both parties at your express request before you have exercised your right of withdrawal.

8. Data protection

8.1 flugsimulator.com uses the personal data provided by the customer for the purpose of contract processing (e.g., name, address, payment details) exclusively for fulfilling and processing the contract. Customer data will not be passed on to third parties except for the purpose of contract execution.

8.2 After full processing of the contract, the customer data will be deleted unless storage is required for legal reasons. If the customer expressly agrees to further processing and use of their data, it will not be deleted.

8.3 The customer may request information on, modification of, or deletion of stored data from flugsimulator.com at any time free of charge. Any consent given can be revoked at any time.

8.4 Our complete data protection provisions can be found on our website under Datenschutzbestimmungen. We will gladly send them to you upon request by email or post.

9. Prohibition of drugs

If the participant has visibly consumed alcohol or mind-altering substances before the simulator flight, the person authorized by flugsimulator.com is entitled to immediately exclude them from further participation. The participation fee will not be refunded in this case.

10. Vouchers

All vouchers expire after the statutory limitation period of one year. The period begins at the end of the year in which the voucher was purchased.

11. Final provisions

11.1 Should individual provisions of the contract with the customer, including these AGB, be wholly or partially invalid, the remaining provisions shall remain unaffected.

11.2 The relationships between the contracting parties shall be governed by the law applicable in the Federal Republic of Germany, excluding the UN-Kaufrecht (United Nations Convention on Contracts for the International Sale of Goods, CISG).

11.3 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of flugsimulator.com GmbH. The same applies if the customer has no general place of jurisdiction in Germany or if their place of residence or habitual residence is unknown at the time of filing suit.
